1) The XYZ Studio just released a new movie entitled “Kill All Whites Now.” The movie’s topic is a religious group whose primary mission is to kill all people with white skin. In certain portions of the movie, the religious group members advocate the immediate murder of any and all white people. The movie’s closing scene features a full-screen shot of the face of the speaker, who is facing the movie theater audience, gesturing with a menacing look, and shouting, “It is everyone?s immediate responsibility to kill all white people by whatever means possible.” Police in some of the cities where the movie was released have reported an increased rate of violence, including murders, committed against white persons in the days after the movie?s release, although there is no proof that any of the incidents were related to the movie or committed by viewers of “Kill All Whites Now.” In addition, several white persons who viewed “Kill All Whites Now” reported to police that they felt “threatened” after watching the movie. The mayors of some major cities have called for the immediate censorship of the movie. XYZ Studios objects to this.
1. What arguments, based on the First Amendment, can you think of that would support XYZ Studios’ rights to distribute “Kill All Whites Now”?
2. What arguments, based on the First Amendment, can you think of that would support the opponents’ call for censorship of the film?
3. Of the above arguments, which are more persuasive and why?
