BUFFOON v CLUELESS

Moot Court Exercise #1
In the Fall of 2016, the small Balkan nation of Smirnoff finds itself in the throes of a civil war. The existing government of reputed Mafia-frontman Prince Edward Inakan is attempting to put down an insurgent uprising led by former strongman Y. Duncha Buzzov. NATO is considering introducing troops in an attempt to establish a tenuous peace and separate the forces of the two antagonists. The United States is a signatory to a NATO treaty that obligates it to contribute no less than 20% of the ground troops for any joint operation. President I. M. Clueless announces publicly that the US believes that its NATO commitments are vital to national security and that he is prepared to order the embarkation of American combat forces as soon as the NATO operation commences.

The House and Senate are alarmed at this proposed exercise of US military force. They pass a Joint Resolution declaring Neutrality toward Smirnoff. Specifically, the Resolution states 1) that we are at peace with Smirnoff, 2) that no funds can be expended from the Treasury for military operations in Smirnoff, 3) and that the President is ordered to turn over to Congress any and all documents related to the President’s decision to participate in the NATO operation. President Clueless vetoes the Resolution, but it passes again by a 2/3 majority in each House.

President Clueless subsequently orders the 82nd Airborne Division to depart for Smirnoff in order to participate in the NATO operation. General James (Jim) Nayzium, commander of the 82nd, refuses to obey the President’s command claiming that the President’s order is unlawful. President Clueless relieves General Nayzium for disobedience and replaces him with General William “Wild Bill” Hickok. While the troops are preparing to embark, the Speaker of the House, Congresswoman Ima Buffoon, appears in D.C. Federal District Court and files a petition commanding the President to 1) comply with the provisions of the Smirnoff Neutrality Resolution and 2) to restore General Nazium to his former command until the President appears before the Senate to explain his actions.

The District Court, recognizing the need to expedite the case, certifies the matters of law directly to the Supreme Court. (NOTE: You may assume for purposes of this exercise that this procedure is permitted under existing court rules.)
