My aunt will be issued a Spanish Passport. She will travel to Spain from Cuba and the next day travel to Miami Fl avoiding resident issues. Should she travel from Spain to US with her Cuban Passport or her Spanish Passport? She intends to ask for refugee asylum and present her Cuban passport and Certificate of birth at Miami International. QUESTIONS:
1. What are the consequences for boarding a plane in Spain with a Spanish Passport as far as asking for refugee status or any other status when arriving in the US and claiming Cuban Citizenship?
2. Can she travel to the US from Spain with her Cuban Passport and is this permissable under Spanish law?
3. What are the consequences if any in using her Cuban Passport to travel from Spain to US?
4. Does she need to fill out an ESTA application in order to travel from Spain to US or any other travel visa?
5. What is the most efficient, lawful (under US immigation law)and safest (avoiding deportation) way for her to ask for and be given permanent residency or parole at point of entry to US and what documents or forms must be filled out BEFORE travel to US if any? In other words, under USImmigrationLaw, how can she legally travel to US and ask for resident or refugee status when coming from Spain holding a Spanish and Cuban Passport?
