One of the most interesting and politically charged ethical debates of our time regards the morality of abortion. Because there is no clear cut consensus about this issue, US citizens have disagreed with each other regarding whether or not the “right to abortion” is an issue about the “right to life” of the fetus, and therefore, should be criminalized or the “right of sovereignty” a woman has in regards to her reproductive system, and therefore, should be legalized. In response to these differences of opinion, the US Supreme Court declared in the landmark case, “Roe v Wade” that a woman has the right to abort her fetus if she so desires but added regulations regarding the process of abortion. With that in mind, although creating laws to maintain social cohesion and minimize the damage that would be done by the exercise of unbridled individual desires is part of the function of government, the question is raised: Is it ethical for federal and state governments to give women the “right to abort” to the exclusion of the “right to life” of the fetus and the “rights” of the father in determining whether or not he wants to abort the fetus? Explain your answer according to the premises of social contract theory.
