Questions 1-3, 4(specific)

a.    Please identify the theme – i.e., the commonality/ /principle/theory that causes these cases to be paired. (Short answer is fine.)

b.    Please analyze caselets in the pairings as we analyzed them in class according to the elements.  Assume that performance does not occur as expected.  In other words, one party does what he/she promised, but the other party does not want to perform his/her part.  Is the contract enforceable?  If relevant, what happens to the subject matter of the contract?  Again, if relevant, what sort of damages are recoverable and why?  (Short answer is fine.)

c.    In your answer, make sure and compare/contrast/distinguish the caselets.  What does analysis of each caselet contribute to understanding the theme of the pairing?

d.    What are the takeaways for business people?  In other words, how might understanding the holdings of these caselets influence your bargaining in the future?  (Please write in complete sentences, but a concise response is fine.)

e.    Note:  Make sure and include all (two or three) caselets discussed relevant to the pairing!  In addition, while it can be helpful to provide context/background concerning the facts, if you do so, please do so succinctly by highlighting only the essential facts – do not simply rewrite the entire caselets.  Points will be deducted for writing too much detail.  When mentioning elements of a contract, it is not sufficient simply to say “yes” or “no” that they are or are not present; you must mention how specifically how the elements are or are not met.
