Tasks:  This second attempt piece of coursework consists of questions based on a case study and requires students to:-

•    Recognise, understand and apply appropriate case law and legislation to realistic business problem scenarios

•    Critically evaluate the law relating to contract and employment law

•    Understand principles of law governing contract and employment relationships

•    Analyse complex factual situations and identify and apply relevant legal concepts in order to reach balanced conclusions and provide advice and

recommendations.

Referencing: Students must reference sources using the Oxford Standard for the Citation of Legal Authorities (OSCOLA). This can be found at http://www.competition-

aw.ox.ac.uk/published/oscola_2006.pdf. Reference should be made to the primary source, except when the primary source can no longer be obtained. Poor citation of

Case Study – Problems at Accounting for Small Business

Accounting for Small Business (AFSB) owns a number of accountancy firms in the South and West of England and has a problem involving some computer screens it has

bought and some staffing issues at its Southampton office. Read the following information and then answer the three questions at the end:

Simon the purchasing manager orders 200 new computer screens from a wholesaler.  He then saw some advertised more cheaply.  He sent a fax cancelling the order and

immediately purchased the cheaper computer screens.  In the meantime, however, upon receipt of AFSB’s order the wholesaler sent AFSB a letter confirming the order.

AFSB have received this letter but is now worried about how many contracts have been made to buy computer screens.

In the Portsmouth office, Sarah the recently appointed Office Manager is struggling to manage some members of staff and her relations with them are not good. Some

staff regard her as being unduly authoritarian in her relations with them and believe that she often picks on a few members of staff to do the more demeaning work.

Fred has worked as an Assistant Office Manager at the Southampton office for 6 years.  As Sarah seems to be struggling with recent events, she has decided to take a

long holiday and Fred has been asked to take over from her at the Portsmouth Office for the next three months.  Fred likes working in Southampton, it suits his

lifestyle.  He lives very close to the Southampton office which means he can stay at home with his children until they go into school in the morning and he can be at

home again soon after they finish in the evening. Fred refuses the request to move to the Portsmouth Office even on a temporary basis. Meanwhile it is decided that the

Southampton Office (which currently employs 100 staff) is to close early in 2015 and that Fred, along with others will be transferred to the Portsmouth Office on a

permanent basis.

Question 1            With regard to the computer screens advise AFSB of the relevant                 law and your conclusions regarding

their own legal position.

Question 2     Advise Fred of any claim he may have in relation to the request for a temporary move to the Portsmouth Office.

Question3    Advise Fred and other staff currently working at the Southampton Office as to their rights in relation to the closure of that office and the transfer

Magley Custom Kitchens (MCK) is a company designing and manufacturing fitted and custom-made kitchen furniture operating from a Business Park in Cambridge. The company has 250 employees and has been operating for 15 years. You are the HR Manager and you have received a letter of complaint from Sarah Mitchell. Sarah has only recently returned to work after caring for her two children for a number of years. She has completed a part-time design course at her local college over the past three years, achieving excellent marks. She has been looking for a full-time position for a couple of months, rather than the temporary jobs she has been able to obtain. Sarah applied for a job with MCK as a kitchen designer two months ago. She was given an initial interview but was not short-listed for a final interview. The position was offered to a recent graduate with a qualification in design, although they had not achieved as high a grade as Sarah.
A week after Sarah’s rejection letter from the company arrived she was having coffee in the local coffee shop when she recognised at the next table the person who had interviewed her at MCK, John Barnsley – the Design Studio Manager. She went up to him as she was leaving and she told him how disappointed she was not to get a final interview. He told her that she wasn’t really suitable for the job because she was 43 years old and the company wanted to present a ‘young designer’ image.
Sarah has written to you saying that, although she realised that the initial job advertisement had specified that the candidate be under 40 years of age, she thought she would be very good at the job and she felt it was unfair not to consider her because of her age.
You are asked to consider the legal implications of this situation and should outline the actions that may result from this complaint.

This question requires a basic understanding and appreciation of the different branches of law within the English legal system. There are two parts to the question – firstly, students should say whether they agree with the statement regarding the law of tort and contract and explain their reasoning and secondly (probably the larger part of the essay), how and why the law of obligations fundamentally differs from the criminal law. Students should demonstrate the ability to differentiate between the three types of law, and, where appropriate, to substantiate discussions with relevant case law and legislation. There are numerous differences/similarities between the three and a good answer will probably use a ‘compare and contrast’ approach of choosing and explaining an issue in a paragraph and then move onto the next issue in another paragraph. The facts are all important and application of the law to the facts is essential. Students will frequently write out all the law they consider to be raised by the facts and then, without separating the issues clearly, leave all their application to the end. Students should state the law in the context of the issue raised by the facts, giving supporting legal authorities throughout for the principles that are discussed. The relevant section numbers of the correct applicable Act of Parliament are essential requirements along with relevant legal cases which illustrate the issues.
Students may wish to follow the ‘IRAC’ formula in forming discussions for the problem question.
‘I’ – IDENTIFY’ the issue (Age discrimination)
‘R’ – Explain the ‘RULES’ (the law – legislation and judicial precedents from 2 or 3 Real life United kingdom’sLegal cases) surrounding the relevant area/ issue
‘A’ – APPLY the RULES – the relevant legal principles – to the issue and APPLY legal cases to support the opinion.
‘C’ ­ give a CONCLUSION to the issue. This formula may be used over and over again in addressing all of the issues relating to each of the parties in the assignment question.
An overall conclusion should be given which summarises the situation and suggestions as to how to deal with/prevent this type of problem occurring in the future.

The list of references should include a list of the legal cases and legislation mentioned in the answer. The legal cases and legislation are the primary sources of information in a law essay – the student does not have to cite the secondary source where they viewed a case. The student should only give the legal citation, not the website or book where they accessed details of the case. For example, this is the correct reference for this case – London Borough of Tower Hamlets v Mr J Wooster [2009] All ER (D) 160 – not London Borough of Tower Hamlets v Mr J Wooster, Turner, C(2013) Unlocking Employment Law, 383.
