Project description
This essay’s topic is ‘The EU and the USA have different approaches to the data protection. Which, if either, is likely to be more sustainable in the future?’ which need to refer to the proposal that will upload. Please read the documents uploaded carefully and if you have any questions, please tell me. Thank you
This is an important subject, since you will find that you are addressing some important questions about the role of government.
Consider what would make each approach sustainable: i.e. able to survive in the long term.
For the US, you are likely to outline general principles, while the EU does have detailed regulations. You might end up arguing that the free market principle of the US approach is inherently sustainable, because it is flexible, or that it doesn’t do enough to promote trust in protection of personal data. But specific parts of the EU data protection directive may come to be out of date, while the general approach continues. So you need to be careful, if you are arguing about the EU approach – are you addressing parts of the EU directive, which could be changed, or are you critiquing the whole idea of an international standard and national commissioners.
For a review of EU data protection, consider tComputer Law & Security Review, Volume 18, Issue 1, 31 January 2002, Pages 31–47
Suggested arguments: History is the sole reason that there are different approaches in the EU and US towards data protection. Adopting a tiered approach to the concept of PII “personally identifiable information” (PII) (referred to as “PII 2.0”) will bridge the differences regarding the current PII approaches in the United States and European Union. See article: Reconciling Personal Information in the United States and European Union by Schwartz and Solove (2013)– an interesting read Hope this helps Natassa
