Essay scenario:
Kelly goes to a nightclub where she meets Dave and Peter. She challenges them to a drinking game. They all drink heavily during the evening and return to Kellys hotel room.
Kelly is a drug addict and starts to inject some heroin. Peter has never tried drugs before and asks if he can try some. Kelly hands him a syringe. Peter injects himself and immediately collapses, frothing from the mouth. Kelly ignores him and turns her attention to Dave.
Dave, a professional athlete is not used to drinking heavily. Kelly helps him onto the bed and then has sexual intercourse with Dave.
Kelly later calls an ambulance when she sees Peter is still unconscious. Despite an ambulance arriving within a few minutes, Pete cannot be resuscitated and dies.
When the police attend Dave says he has no memory of what happened after leaving the nightclub.
Discuss the criminal liability of Kelly.
